Terms and Conditions of Sale (TCS)
1. Purpose
These Terms and Conditions of Sale (TCS) apply to all services offered by Espace Zen’ing, operated by Tourisme et Bien-Être (SIRET 79308281900012), whose registered office is located at 2 rue Denis Papin, 59147 Gondecourt, France.
They govern the contractual relationship between Espace Zen’ing and any individual (hereinafter referred to as “the Client”) wishing to benefit from a treatment, massage, spa, or hammam session.
Booking any service implies full and unconditional acceptance of these TCS, which prevail over any other document.
2. Services
The services offered (massages, beauty treatments, hammam, jacuzzi, etc.) have no medical or therapeutic purpose.
Massages provided are wellness treatments and cannot be considered as physiotherapy.
Espace Zen’ing reserves the right to modify the content, duration, or pricing of its services at any time without notice, except for confirmed bookings.
3. Booking and Payment

A booking is considered confirmed once full payment or a deposit has been received, according to the conditions specified at the time of reservation.
Payments are accepted in cash, credit card, Espace Zen’ing gift vouchers, or partner gift cards (subject to prior agreement).
4. Cancellation or Rescheduling
Any cancellation or rescheduling must be notified at least 48 hours in advance.
In case of late cancellation or no-show on the day of the appointment:

The full amount of the service will be charged,

Gift vouchers or prepaid cards will be considered used.
Espace Zen’ing reserves the right to cancel or postpone a service in the event of force majeure (breakdown, illness, weather conditions, etc.). In such cases, no compensation can be claimed, and a new date will be offered.
5. Gift Cards and Vouchers
Espace Zen’ing gift vouchers and prepaid cards are valid for 8 months from the date of purchase.
They are non-refundable and non-exchangeable, even in case of loss, theft, or non-use before the expiry date.
Any extension of validity is at the discretion of management.
VAT Regulation:
The sale of a gift voucher does not constitute a taxable transaction. VAT is applied only when the corresponding service is performed.
The final service invoice will then include the applicable VAT rate.
6. Client Delay
In the event of a late arrival, the duration of the service may be shortened to avoid affecting subsequent appointments.
No refund or compensation will be granted for lost time.
7. Access Conditions and Safety
Access to the spa area is restricted to adults or minors accompanied by an adult. Age required : 8 years old
The client agrees to comply with the hygiene and safety rules displayed in the establishment.
Espace Zen’ing reserves the right to deny access to anyone whose behavior is deemed inappropriate, indecent, or disruptive to the tranquility of the premises.
Swimwear is mandatory. Personal belongings remain the sole responsibility of the client.
8. Liability
Espace Zen’ing declines all responsibility in the following cases:

Accidents resulting from non-compliance with safety instructions,

Loss or damage to personal belongings,
-
Skin reactions or allergies linked to the client’s health condition.
Clients are required to inform the therapist of any medical condition, injury, or allergy before the session.
9. Pricing
Applicable prices are those in effect on the day of booking.
Prices are expressed in euros, all taxes included.
Espace Zen’ing reserves the right to modify its rates at any time without notice, except for prepaid bookings.
10. Personal Data
Collected data (name, phone number, email, booking history) are used exclusively for appointment management and internal communication.
In accordance with the GDPR, the client may at any time request the correction or deletion of their data by email at [insert center email address].
11. Complaints
Any complaint must be submitted in writing within 7 days after the service to:

In the event of a dispute, and after an attempt at amicable resolution, the client may refer the matter free of charge to a consumer mediator, in accordance with Article L612-1 of the French Consumer Code.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by French law.
Any dispute not resolved amicably shall fall under the jurisdiction of the courts where Espace Zen’ing’s registered office is located.
13. Additional Legal Notice (B2B Billing)
For invoices issued to professionals, any unpaid amount after the due date will incur:

Late payment penalties at the legal rate in effect,

A fixed compensation fee of €40 for recovery costs (Article D441-5 of the French Commercial Code).
